Four years in prison to a driver who killed a cyclist and fled the scene

The ruling of the trial against an 25 driver who killed an 33 cyclist in Madrid for years and who did not even stop to see how the cyclist was. The events occurred last 6 March of 2016.

El País newspaper publishes that the head of the Criminal Court number 13 of Madrid, Francisco Manuel Bruñen Barrera, has considered it  guilty of a crime of murder for serious imprudence and from another one Failure to provide relief. The magistrate reproaches the author of the outrage for putting herself at the controls of her vehicle despite being exhausted and for not stopping to see how her victim had been.

The sentence, against which there is an appeal to the Provincial Court of Madrid, considers it proven that the 25-year-old driver drove the Mercedes owned by her mother at 03.30:180 on the day of the accident, despite “being aware of being extremely fatigued ”. He went down Alberto Alcocer Street (Chamartín) in the direction of the Cuzco roundabout. At the height of Padre Damián street, the woman made a XNUMX-degree turn to go home through the Dominican Republic square. This maneuver was prohibited.

The driver was placed in the right lane of ascent to a speed between 55 and 65 kilometers per hour, despite being limited to 30. "By not providing the minimum attention required for driving, he did not notice, despite being perfectly visible from at least 50 meters, and despite the absence of traffic, the presence of the bicycle service Bicimad led by Javier Vela Rodríguez, 33 years ", Says the sentence. This maintains that the cyclist had lit the front and rear lighting. The area was well lit and the visibility was good, despite being at night.

At the height of the number 24 of the street of Alberto Alcocer, the SUV collided "by reach" with the bicycle and the cyclist. He received the blow in the lower back and buttocks. By the violence of the crash, hit the head on the hood and was fired about 10 meters. The bike was dragged 2,65 meters and no signs of braking were found. In the accident, the Mercedes broke part of the bumper, the right front headlight and part of the hood sank. "In order to ensure her impunity, [the driver] decided not to stop and get out of the vehicle, but to continue her march and leave the scene, without ascertaining the condition of the run over or if she was being attended by third parties" , pick up the fault.

The magistrate maintains that the defendant conducted in a "completely careless" manner: "The circumstances of the collision are revealing that the accused did not pay due attention to the movement, resulting in the fatal accident."

The judge devotes a large part of the sentence to the woman's behavior after being run over. He maintains that the accident produced a loud noise and great violence, so there is no doubt "that the driver perceived it". "The defendant did not do what normally would be done, which is to stop the vehicle and get off it. He chose to continue forward without stopping, to get away from the place without being identified and try to avoid responsibility, seeking impunity", Adds the sentence. "In short, the defendant fled," he concludes. Therefore, the conviction for a crime of omission of relief.

The judge applies two years and two months for each crime given the seriousness of the result: "We witness the frequent death of cyclists because of the low consideration of some drivers to their vulnerability, there is a settled social conscience that demands the need for respect and attention to the cyclist circulation ".
