The processing of the reform of the Penal Code to increase the penalties for drivers who run over bicyclists, resulting in death, enters its final stretch. Six months after Congress unanimously approved the consideration of a Law Proposal of the Popular Party, the parliamentary groups have established a position on this reform.

Once the deadline for submitting amendments has ended, the popular have received a total of 15. The most striking are those presented by the Socialists, since they ask lower penalties that had raised in his initiative the Popular Party. A sanction that goes in the direction of imposing a penalty of up to nine years in prison in the event of several deaths, as a result of reckless driving of motor vehicles, resulting in death. The PSOE asks that it be only six years, two more than what the Penal Code now sets, which is four.

Likewise, they reject the creation of a specific subtype in the Penal Code, which includes the crime of abandoning the scene of the accident, with an autonomous wording.

The socialist deputy Pablo Bellido justifies to ABC the position of his group to reject the creation of a new criminal offense in which "there is no need to mess up the legal system and tweak the entire Penal Code." As an alternative, they ask that "the maximum sentence be applied when raising a grade and sanctioned with more punishment" the abandonment of the scene of the accident, when there is a deceased.

Abandon populisms »

Bellido points out that "it is not decaffeinated" the Popular Group Law Proposal because the objective was for the fleeing driver to have a "special reproach." Creating a subtype in the Penal Code that stiffens the penalty of omission of the duty of relief does not have much difference with what we propose ».

In relation to the second amendment, Bellido considers more balanced the penalty of between two and six years, and not nine as proposed by the PP, "Because it generates insecurity." The PSOE believes that it is necessary to "abandon populists and partisan tendencies." In this sense, he assures that they will make an effort “to reach an agreement. The important thing is not to be right, or to impose our criteria. If we are not able to reach an agreement on Road Safety? What are we going to be like? ».

Citizens do not share the proposals of the PSOE on sanctions, "that wants to decaffeinate them," says spokeswoman Irene Rivera. This political training calls for increasing the penalty of deprivation of the right to drive, in the case of death, from one and a half to six.

After the presentation last Wednesday in the Congress, the popular ones are going to start negotiating the amendments. Congresswoman María Jesús Moro has shown herself willing to “seek the maximum consensus so that the final proposal is balanced. We will all have to find the middle ground ».
